Life is working out pretty well for just about all the other characters in Californication - Becca's boyfriend loves her, Karen has a job back in New York, she's feeling good about Hank and happy to leave Becca in his good keeping, Hank's even ok with Mia going on tour with his book - yeah, life's taking a good turn for everyone - with the exception of course of Runkle, whose masturbation once again gets him into trouble.

And I guess life didn't work out too well, either, for Lew Ashby, who died last week. He was a great character, though - the musical equivalent to Hank's writer - and Hank's book about him could well be the beginning of a new day for Hank's writing.

Speaking of writing, Tom Kapinos gets big creds for sparkling great dialog in Californication. David Duchovny continues to be perfect as Hank, so does Evan Handler as Runkle, and you couldn't ask for anything more from Callum Keith Rennie as Lew. The women were all fine, but I especially liked the newcomers Daisy (Carla Gallo), Janie (Mädchen Amick), and Surfer Girl (Michelle Lombardo), who, come to think of it, was also on in 2007. Anyway, I hope we see all of them back next year, and hear more Warren Zevon, who's "Keep Me in Your Heart" was a great theme for last night.

He leads Thailand's opposition Democrat party.

The Democratic Party are associated with the thuggish, right-wing People's Alliance for Democracy (PAD).

In elections at the end of 2007, Abhisit and his Democrats were heavily defeated by Thaksin's allies.

Iraqis and other Arabs erupted in glee Monday at the shoe attack on George W. Bush. Far from a joke, many in the Mideast saw the act by an Iraqi journalist as heroic, expressing the deep, personal contempt many feel for the American leader they blame for years of bloodshed, chaos and the suffering of civilians.

Images of Bush ducking the fast-flying shoes at a Baghdad press conference, aired repeatedly on Arab satellite TV networks, were cathartic for many in the Middle East, who have for years felt their own leaders kowtow to the American president.

So the sight of an average Arab standing up and making a public show of resentment was stunning. The pride, joy and bitterness it uncorked showed how many Arabs place their anger on Bush personally for what they see as a litany of crimes -- chief among them the turmoil in Iraq and tens of thousands of Iraqi deaths since the 2003 U.S. invasion.

The reaction explains in part the relief among Arabs over Barack Obama's election victory, seen as a repudiation of the Bush era. But it also highlights the task the next president will face in repairing America's image in the Mideast, where distrust of the U.S. has hampered a range of American policies, from containing Iran to pushing the peace process and democratic reform.

FAS Secrecy News: DoE Seeks to Limit “Public Interest” FOIA Disclosures http://www.fas.org/blog/secrecy/2008/12/public_interest_disclosures.html Mon, 15 Dec 2008 21:38:51 +0100 FAS Secrecy News http://www.fas.org/blog/secrecy http://www.fas.org/blog/secrecy/2008/12/public_interest_disclosures.html A proposed new Department of Energy regulation would eliminate the so-called “public interest” balancing test that encourages DOE officials to release information under the Freedom of Information Act even when it is legally exempt from disclosure if doing so would serve the public interest.

“This proposed rule would remove the so-called ‘extra balancing test’… which states: ‘To the extent permitted by other laws, the DOE will make records available which it is authorized to withhold under [the FOIA] whenever it determines that such disclosure is in the public interest’,” according to the December 9 proposal published in the Federal Register.

“This additional [public interest balancing] test requires DOE to make available records that could be withheld under the FOIA exemptions, if DOE determines that disclosure would be in the public interest. DOE is proposing to remove the extra balancing test, because it goes beyond the requirements of the FOIA, and imposes unnecessary administrative requirements on DOE.”

It is true, by definition, that the balancing test in the existing DOE regulation “goes beyond the requirements of the FOIA,” because it encourages disclosure of records the release of which is not legally required.

But in an apparent non-sequitur, DOE also said that “the extra balancing test does not alter the outcome of the decision to withhold information, as DOE already incorporates Department of Justice guidance in applying exemptions when determining whether or not to make a discretionary release of information.”

The difficulty with that statement is that current Department of Justice guidance on discretionary release does not require explicit consideration of the public interest in disclosure of exempt information. To the contrary, it promotes withholding of exempt information and promises to defend agencies whenever they legally withhold such information.

In effect, the existing DOE regulation incorporates the 1993 FOIA policy enunciated by then-Attorney General Janet Reno (and long since abandoned by other agencies) which encouraged discretionary disclosures unless there was a “foreseeable harm” to a legitimate government interest. And the proposed new DOE revision reflects the 2001 FOIA policy of Attorney General John Ashcroft, who discouraged discretionary releases (though he did not prohibit them) and urged withholding of records whenever there was a “sound legal basis” for doing so. As noted in a November 19, 2001 Defense Department memo (pdf), under the Ashcroft FOIA policy “Discretionary disclosures are no longer encouraged.”

It is interesting to observe that with the current DOE FOIA regulation in effect there has been a striking difference in FOIA implementation between the Department of Energy and other agencies.

Earlier this year, for example, President Bush ordered executive branch agencies to provide comments on the recommendations of the Public Interest Declassification Board for improving declassification practices. Requests under the Freedom of Information Act for copies of these comments were consistently rejected by the Office of the Director of National Intelligence, the Department of Defense, the Department of Homeland Security and other agencies. These agencies correctly noted that the comments were inter-agency deliberative materials that were exempt from disclosure under FOIA exemption (b)(5).

But one agency released its comments in full, despite the availability of an exemption: the Department of Energy. (See “Energy Dept is ‘Committed’ to Improving Declassification,” Secrecy News, June 5). In other words, it appears that the public interest balancing test and the approach to FOIA that it represents do alter the outcome of the disclosure decision process at DOE.

In comments on the proposed regulation submitted by the Federation of American Scientists, we argued that “there is a widespread and well-founded expectation that the incoming Obama Administration will rescind the Ashcroft FOIA policy and define a more forthcoming disclosure policy. In light of that probable scenario, I would urge DOE to cancel its proposed revision of [the public interest balancing test], or else to suspend action on it for six months while the new Administration prepares new government-wide FOIA guidance.”

In a study (pdf) prepared for the Office of the Director of National Intelligence, the JASONs concluded that “No foreign threat in HFGW is credible, including: communication by means of HFGW; object detection or imaging (by HFGW radar or tomography); vehicle propulsion by HFGW; or any other practical use of HFGW.”

Gravitational waves were predicted by Einstein’s general theory of relativity and their existence has been indirectly confirmed by experiment. But up to now they have never been directly measured.

“Unfortunately, relativity and gravitation theory have, over the last century, been the subject of a great deal of pseudo-science, in addition to real science. Therefore, in evaluating ambitious claims about gravitational applications, one must consider the possibility that the claims are misguided and wrong,” the JASONs advised. “There is no substitute for seeking expert scientific and technical opinion in such matters.”

Russ Feingold urged the next Administration to take a series of specific measures to strengthen the rule of law. Distilled from the record (pdf) of a September 16 Senate Judiciary Committee hearing on the subject, the recommendations addressed four topics in particular: separation of powers, excessive government secrecy, detention and interrogation policy, and domestic surveillance.

The letter’s recommendations on combating excessive government secrecy included brief reference to a proposal stressed by the Federation of American Scientists for a fundamental review of agency classification guides to eliminate obsolete or unnecessary classification instructions.

Establishing such a review may be even more important than revising the executive order on classification or rescinding of the Ashcroft policy on FOIA, both desirable steps but which are only loosely coupled to daily secrecy decisions. By comparison, revising agency classification guides — which specify what information shall be classified at what level — and updating them to eliminate spurious secrecy requirements would have immediate favorable consequences for agency practice, particularly since many classification guides have not been reviewed for years. On 13 November Palestinian conceptual artist Emily Jacir was awarded the prestigious Biennial Hugo Boss Prize. Established in 1996 in conjunction with the Solomon R. Guggenheim Foundation to "recognize significant achievement in contemporary art," the prize includes a $100,000 award and a solo exhibition at the Guggenheim Museum New York in 2009. The award is the latest honor for the celebrated artist. Maymanah Farhat reports.

I don't watch US television, as a rule, but I do get Media Matters for America in my email, watching the right-wing media's lies and slander antics. Here's their latest update on Sean Hannity's view of nutjob Illinois governor Rod Blagojevich, (caught last week auctioning off the senatorship now that Obama's moved on) and Obama or his still-under-construction administration.

Hannity says, in part:
HANNITY: Well, Patrick Fitzgerald, the U.S. attorney -- and I read a story about him, that when he's involved in a case, this guy won't take a break, won't even take a day off until the case is finished. So he's fairly relentless as he goes forward here. Now, I watched his statement the other day very, very closely when this all came out, and what he said was, "There's no allegation in the complaint that the president-elect was aware."

I found that as sort of almost like a parsing of words, because the word "president-elect" was mentioned -- what -- I think some 44 times, Karl, which I think is a pretty high, high number.
Ol' Sean doesn't mention that "In fact, with one exception, none of the 44 instances in which "president-elect" was used in the complaint actually mention any alleged conduct or statement by President-elect Barack Obama or his representatives, much less any conduct or statement amounting to wrongdoing. The one exception consisted of an allegation that Blagojevich complained that Obama would not give him anything other than "appreciation."

Gee, when I Googled "hannity" plus "slander", I got 77,300 hits, which I think is a pretty high, high number.

Oh, for bonus points, Hannity was chitchating with Karl Rove, who's currently working as a colour commentator for Fox News (and apparently still working behind the scenes with the GOP.)]]>

India's air force was preparing for a likely strike against Pakistan following the Mumbai terror attacks, Pentagon sources told CNN.

The report quoted three Pentagon officials as individually confirming the Untited States has information about Indian air force personnel preparing for a possible mission against Pakistan.

One official told CNN the Indian air force "went on alert" after the Nov. 26 attacks in India's financial capital. The attacks ended after three days, leaving at least 170 dead, including foreigners.

India, which captured one of the 10 terror suspects alive, says the suspect has said all the attackers were Pakistani nationals and that the massacre was planned by the Laskhar-e-Toiba militant group in Pakistan.

CNN reported its sources offered few details about the Indian preparations, but added it is the first public indication the two nuclear weapons powers were closer to a conflict in the days after the attacks.

One official told CNN India's preliminary preparations may have allowed it to speedily strike suspected terrorist training camps and targets inside Pakistan. But during this time, U.S. officials were pleading with India to exercise restraint, the report said.

CNN said a spokesman for the Indian air force declined comment on the report.

At least, that’s what AFP is reporting:

He hired specialist architects, sending them to India to measure the dimensions of the real Taj Mahal, and brought six Indian technicians to his building site across the border… Moni imported marble and granite from Italy, diamonds from Belgium and used 160 kilogrammes (353 pounds) of bronze for the dome.

As reports have come in about the “$58 million structure”, there’s been speculation on a diplomatic “fracas” between India and Bangladesh and questions about whether a building can be copyrighted.

It would be nice if someone actually went and visited the building site.

Several Bangladeshi bloggers did just that this past weekend. They reported paying unusually high fees for motorized rickshaws to the site, and an admission charge that was high by local standards. The building itself was underwhelming:

Local tiles on a plain and simple brick structure… even the tiling work is that of an amateur… the structure is still incomplete. Even if after all this they want to put Italian marble where will they put it? All the visitors were upset and were feeling cheated. …After 10minutes we realised that there was nothing to see inside. We left. On the way back we spoke to other visitors and there was only one word going around — “what a scam!”

Bloggers noted that the filmmaker in question is notorious for making cheap Bollywood knockoffs, and consider this the architectural equivalent of such chicanery. The fact that the newspaper story ran during Eid has increased the traffic, as families decided to take Eid trips to visit the “attraction”.

Bloggers are particularly incensed at local media’s role in the scam. Bibortonbadi called one local paper to complain and was told that the paper had simply published an AFP story without any verification:

I was surprised to note that the leading dailies of the country did not do any verification before writing about these false claims such as 400crores BD Taka (58mn USD), 172 diamonds, Italian marble etc. Is 400crores a child’s play? When someone claimed to have spent that kind of money, did they (the MSM) not find the time to verify these tall claims before publishing them as is? At best they would have had to travel for about 1.5hours to do this verification. Is there such dearth of news in this country (that there is no need to verify - anything will do) or can money power get anything published these days? At best only 3/4 crores were spent.

It’s pretty common for professional journalists to complain about poor factchecking in blogs, and the possibility that bloggers will hype stories that professional journalists would have quickly and easily debunked. Here’s a classic counter-example: an international press agency hyped a story which helped rip off Bangladeshis, who used blogs to debunk the story. Here’s hoping the international outlets hyping the story will pick up on the corrections as quickly as they seized on the story.

    At the order of Israel's ministry of the interior, Israeli border police denied Prof. Falk entry into Israel on 14 December 2008, on his way to the West Bank to carry out his official functions. He was deported from Ben Gurion airport in Tel Aviv on 15 December 2008. In March 2008, the UN Human Rights Council voted to appoint Prof. Falk to this position as UN Special Rapporteur for a six-year term. Prof. Falk's duties include preparing reports on human rights violations in the Occupied Palestinian Territories, informing the UN about his work and conclusions, and suggesting ways of alleviating these violations.

    On Monday, Israeli military detained three Palestinian residents from the West Bank city of Bethlehem, Palestinian security sources reported these stories and more coming up Stay tuned.

    The sources said that a contingent of Israeli troops broke into the Za'tara and Dar Salah neighborhoods in southern Bethlehem. Witnesses said that Israeli soldiers ransacked the residents' houses, detained three inhabitants, and took them to an unknown destination.

    In another story, after a brief delay on Sunday due to an injunction by Justice Elyakim Rubinstein, the Israeli High Court agreed to allow the Israeli government to go forward with the release of 230 Palestinians on Monday. Approximately 11,000 Palestinians still remain in Israeli prison camps, many of them held without charges.

    The High Court Justice filed the injunction in an attempt to intervene on a decision made by the Israeli government to release 227 of the 11,000 Palestinians imprisoned in Israel. Rubinstein filed the injunction to ask for an assurance from the Israeli government that none of the imprisoned Palestinians had been charged with injuring or killing any Israelis. After receiving that assurance early Monday morning, Rubinstein lifted the injunction.

    Also today, Haaretz reported that, “the statistical annual report shows that the Jewish population in the West Bank more than doubled during that time, with a growth of 107 percent. The report also shows that the settler population has surged from 130,000 in 2005 to 270,000 by the end of 2007.”
    During the same period, the entire population of Israel only grew by 29 percent.

    Haaretz reports that this population trend has continued over the last three years; the West Bank settler population has grown by five percent annually, in contrast to a 1.7 percent growth rate for the entire country.

    In Israel, on Sunday, December 14, Israeli Authorities held the United Nations Special Rapporteur, Professor Richard Falk, on the situation of human rights in the Occupied Palestinian Territories (OPT) and is willing to deport Professor Falk to Geneva this morning, Wafa news agency reported last night.
    Falk had come to detect Israel's violations of international and international humanitarian laws in the OPT. Upon his arrival, Israeli Authorities denied him access into Israel and held him in immigration at Ben Gurion Airport in Tel Aviv. Israeli authorities are to deport him to Geneva this morning.

    This is Falk's first official visit to the OPT and Israel after he was appointed by the United Nations Human Rights Council (UNHRC) to specifically oversee human rights violations in the OPT. He is currently working on a report about the human rights conditions in the OPT in order to deliver the analysis to the UNHRC’s tenth session in March of 2009.

    In international politics, An international conference on jihad that took place in Jerusalem on Sunday highlighted what far-right scholars on Islam described as ‘real disputes’ about the nature of the greater problem. Far-right and controversial Dutch legislator, Geert Wilders, plans to organize a European ‘follow-up’ in the coming months, Haaretz online reported on Monday.

    Wilders received a standing ovation from the 600-plus people in the audience after stating such absurdities "as the terrorist attacks in Mumbai proved, there's no moderate Islam." He reiterated that it was “time for the West to realize it is in a conflict with the Muslim faith at large.”

    Wilder holds a strong belief, also held by many other far-right leaders across Europe and the United States, that moderate Islam ‘does not exist’ and that there was no way to ‘reform or modernize’ the Koran.

    Wilder also said that key to his war on Islam would involve "crushing the Palestinians' hope for eliminating Israel". He also apposes the creation of a Palestinian state and the ongoing peace talks, brokered by the United States and Egypt.

In 2005 the organization funded a study which claimed that in the US alone, over $6 billion was lost to MPAA members due to piracy. However, the figures and data behind those claims have never been publicly released, and it later became apparent that they were not completely accurate.

    In fact, earlier this year the MPAA had to release a statement saying ‘they made a mistake’ in the figures. Nevertheless, the $6 billion figure in question has been quoted a lot, with MPAA chairman Dan Glickman still using it in almost every public talk, to convince his listeners of the seriousness of the ‘piracy’ issue. According to the MPAA there is more bad weather ahead, as it is now worried that piracy might flourish in the current financial climate.

    “If you look at the situation, the current economic crisis makes this problem much more serious than before,” Glickman said recently at a forum, adding, “If we don’t protect IPR (intellectual property rights), our economic losses will be far worse.” The MPAA will of course leave no excuse unused to justify its anti-piracy measures, nothing new there. Although there are no studies that show how illegal downloads actually affect sales at the box office, there has been a significant bump in the number of BitTorrent users recently.

    One should always be cautious to interpret these two events as having a causal relationship. However, after several months of relatively slow growth, BitTorrent sites have seen a dramatic increase in visitor numbers this fall. Since September, the number of peers tracked by The Pirate Bay has nearly doubled from 14 million in early September, to 25 million now. Other BitTorrent sites such as Mininova, Torrentz and BTjunkie report an increase in downloads, searches and web traffic, ranging from 25 to 50 percent over the same time frame.

    This increase, even if it is directly related to the economic downturn, is not necessarily linked with a drop in box office grosses or DVD sales. ‘The Dark Knight’, which is the most downloaded movie on BitTorrent in 2008 sold millions of DVDs, and grossed a record breaking billion dollars in cinemas worldwide. That does not really sound like a ‘bad year’ to us.
